By creating an account or using the service you agree to these terms. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.
1. What this service is — and what it is not
1.1 SweepSquad is software that helps you organise and manage sweepstakes, pools and prize draws (for example, a workplace sweepstake on a football tournament). It allocates entries, tracks participants and displays results.
1.2 We are a software provider only. We are not a gambling operator, lottery promoter, bookmaker or betting intermediary. We do not run, promote or facilitate gambling, and we do not hold a Gambling Commission operating licence.
1.3 We never handle the money. The service does not collect, hold, escrow, process or distribute any entry payments, stakes, pot or prize funds. All money relating to any sweepstake you organise is handled entirely by you, outside the service. Any figures you record in the service (such as the amount each participant has agreed to contribute) are your own records and are not payments to or through us.
1.4 Your subscription fee is payment for use of the software. It is entirely separate from, and unrelated to, any sweepstake pot. We take no share of any pot.
2. Your role and your responsibility for legality
2.1 When you use the service to set up a sweepstake you are the "Organiser". The people who take part are "Participants".
2.2 You are solely responsible for ensuring that any sweepstake you organise is lawful. Using the service does not make a sweepstake legal and is not confirmation by us that your sweepstake is legal.
2.3 In Great Britain, an office-style sweepstake is normally a "lottery" under the Gambling Act 2005 and is lawful without a licence only if it meets the work-lottery exemption. You acknowledge that this requires, in particular, that:
(a) everyone taking part works at the same single set of premises; (b) entry is offered only to people who work at those premises; (c) no profit is taken — all proceeds go to prizes or reasonable expenses, or the sweepstake is run wholly for a purpose other than private gain; (d) the person organising it works at those premises; and (e) all participants are aged 18 or over.
2.4 You acknowledge that running a paid sweepstake across multiple sites or including remote workers in a single pool, or taking a profit from it, may amount to an unlicensed lottery, and that a paid prediction pool may amount to betting — either of which may be a criminal offence for which you, as Organiser, are responsible. If you need a setup of that kind you must obtain the appropriate Gambling Commission licence yourself; the service does not provide one.
2.5 You are responsible for compliance with all laws that apply to you, including in jurisdictions outside Great Britain, where different rules apply.
3. Self-certification
3.1 On sign-up and on creating each sweepstake you confirm that, to the best of your knowledge, the sweepstake will meet the conditions in clause 2.3, that you will not use the service to collect or hold the pot, and that all participants are aged 18 or over.
3.2 We rely on these confirmations. If they are untrue, we may suspend or terminate your account under clause 8.
4. Acceptable use
4.1 You must not use the service: to run a sweepstake you know or suspect is unlawful; to take a profit from a pot in breach of the work-lottery exemption; to operate a cross-site or remote paid pool, or a paid prediction/betting pool, without the necessary licence; to involve anyone under 18; or for any unlawful, fraudulent or harmful purpose.
4.2 You must keep your account credentials secure and are responsible for activity under your account.
5. Subscriptions, fees and cancellation
5.1 The service is provided on a subscription basis. Plans, prices and what each includes are set out at https://sweepsquad.co.uk/pricing and may be updated from time to time; changes will not affect your current paid period.
5.2 Fees are billed annually in advance via our payment provider, Stripe. By subscribing you authorise recurring charges until you cancel.
5.3 You may cancel at any time, effective at the end of your current billing period. Except where required by law, fees already paid are non-refundable.
5.4 We may suspend the service for non-payment after notifying you.
6. Intellectual property
6.1 We own all intellectual property in the service. We grant you a non-exclusive, non-transferable licence to use it for your own sweepstakes while your subscription is active.
6.2 You retain ownership of the content and data you put into the service. You grant us the licence needed to host and process it to provide the service (see the Privacy Policy).
7. Liability and no legal advice
7.1 Nothing in the service or our materials is legal advice. Any guidance we provide about running a compliant sweepstake is general information only. You should take your own legal advice.
7.2 To the fullest extent permitted by law, we are not liable for any loss arising from a sweepstake you organise, including any regulatory action, fine, prosecution, dispute between participants, or loss of any pot or prize. You agree to indemnify us against claims arising from your use of the service or any sweepstake you organise in breach of these terms.
7.3 We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law. Subject to that, our total liability to you is limited to the fees you paid us in the 12 months before the claim.
7.4 The service is provided "as is". We do not warrant it will be uninterrupted or error-free.
8. Suspension and termination
8.1 We may suspend or terminate your account if you breach these terms, if your self-certification is untrue, or if we reasonably believe the service is being used unlawfully.
8.2 You may close your account at any time. On termination your licence ends; we will handle your data as set out in the Privacy Policy.
9. Changes to these terms
9.1 We may update these terms. We will give reasonable notice of material changes. Continued use after changes take effect means you accept them. We keep a record of the version you agreed to.
10. General
10.1 These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any non-waivable rights you have as a consumer.
10.2 If any provision is found invalid, the rest continue in force.
